IMPORTANT: After downloading the app, go to the Settings Menu, scroll to the bottom of the screen, and either take a screen shot or write down your Identification Number to save for future reference. We do not store your private information on our servers and are unable to assist you with your account without that number.
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING GABRIEL®. Any violation of our policies shall result in immediate and permanent termination of your service, and without warning. Once your service is terminated, you can’t get a refund for any payments you’ve already made, nor will you be allowed to cash out your points.
This agreement shall remain in effect until terminated by you or the company. The company may, in its sole discretion, at any time and for any or no reason, suspend or terminate this agreement with or without prior notice.
This agreement will terminate immediately, without prior notice from the company, in the event that you fail to comply with any provision of this agreement. You may also terminate this agreement by deleting the application and all copies thereof from your device or from your computer.
Upon termination of this agreement, you shall cease all use of the application and delete all copies of the application from your device.
Termination of this agreement will not limit any of the company's rights or remedies at law or in equity in case of breach by you (during the term of this agreement) of any of your obligations under the present agreement.
Gabriel® point incentives are optional and do not impact the performance of the app. Data from call blocking and reporting smishing attacks enable us to improve our spam detection algorithms.
Prohibited Activities
You are not permitted to copy the Gabriel® App. Additionally, you agree not to:
Use bots or computerized methods to create accounts, or to use any method to create fake profiles,
Use any method either manual or computerized that bypasses the voting system, to earn points,
Use computerized methods or any automation for a mass upload of phone numbers,
Use computerized methods or any automation outside of the app to downvote phone numbers,
Use computerized methods or any automation to generate random Caller ID numbers for blocking,
Aggregate points or team with another user who has used or plans to use computerized methods for mass upload of phone numbers, downvote phone numbers, or generate random Caller ID numbers for blocking,
Make any speculative, false, or fraudulent claims about your membership to any loyalty rewards program,
Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure,
Deep-link to any portion of this site (including, without limitation, the purchase path for any transaction) for any purpose without our express written permission, or
“Frame,” “mirror” or otherwise incorporate any part of this app into any other website or app without our prior written authorization.
If you break any of these rules, we can suspend your account and stop you from using Gabriel® without warning. If you see someone else breaking these rules, please let us know.
Point Redemption Generally
As a condition of using Gabriel®, you warrant that (i) you are at least 18 years of age; (ii) you possess the legal authority to create a binding legal obligation; (iii) you will use the app in accordance with this agreement; (iv) you will only use the app to block nuisance calls and messages, and help us solve crimes and scams that target smartphone users; (v) referrals are for the Gabriel® App; and (vi) all information supplied by you is true, accurate, current and complete. We retain the right at our sole discretion to deny access to anyone to the app, Referral Program, and the services we offer, at any time and for any reason, including, but not limited to, for violation of this agreement.
We reserve the right, at any time, to modify, alter, or update these terms and conditions of use. We will notify you of such changes through the Gabriel® Newsfeed.
Subscription Cancellations
The core app is free, but some parts are available only with a paid subscription. You will be billed in advance on a recurring and an annual periodic basis. At the end of each period, your subscription will automatically renew under the exact same conditions unless you cancel it, or the company cancels it.
You may cancel your subscription or renewal at any time either through your Settings Menu or by contacting the company and providing your 16-digit identification number. You will not receive a refund for the fees you already paid for your current subscription period, and you will be able to access the service until the end of your current subscription period.
Retention of Your Personal Data
The company will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
Misprints and Errors
We endeavor to provide current and accurate information on the Gabriel® App regarding the offers and transactions available to you. Nevertheless, errors and misprints occur. Accordingly, we reserve the right to reject, correct, cancel, or terminate any transaction for which the price, points or offer details were incorrectly displayed or for which any other erroneous or inaccurate information was provided.
We reserve the right to do this at any time during the transaction process, including after a transaction has been submitted and even if the transaction has been confirmed by us. Under no circumstance are we obligated to process or complete any transaction based on any error, misprint, or otherwise.
